Liquidations
The liquidation of an entity (Close Corporation or Company) is a regulated process whereby the affairs of the entity is placed in the hands of a nominated liquidator to ensure that the interest of the group of creditors are protected over the interest of one specific creditor.
Once appointed as the liquidator of an estate it will be our responsibility to ensure that the winding up procedures as prescribed in the Insolvency Act, Companies Act and the Close Corporations Act are finalised and to see to it that the all distributions are dealt with according to the legal preferences allocated to each creditor.
Our services also include the assistance with cross border insolvency advice and to act as a foreign liquidator’s agent in Namibia.
Sequestration
The sequestration, whether it is a voluntary or compulsory sequestration, is a process to ensure that the distribution of a debtor’s estate is done methodical and impartial when the debtor’s assets are insufficient to meet its obligations towards creditors.
As the nominated trustee of a natural person or trust it will be our duty to ensure that the assets are kept safely and realized to ensure that the creditors of the estate will receive, in accordance with the preferences of the Insolvency Act, a distribution which will be beneficial for the group of creditors and not one specific creditor.
Our services also include the tracing of assets and acting as the agent for foreign trustees in Namibia.
Members/Creditors Voluntary Winding Up
We also assist solvent entities to wind up business structures and regularly act as appointed liquidators by attending to the necessary procedures on their behalf and ensure that the entity complies with the prescribed rules that pertain to the winding up of solvent entities.
